Terms and Conditions

Introduction

These terms and conditions (“Terms”) govern your use of the KML Worktops website (https://kmlworktops.london/) (the “Site”) and your purchase of any products or services from KML Worktops (“we,” “us,” or “our”). By accessing or using the Site or purchasing our products or services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or purchase our products or services.  

Definitions

  • “The Company,” “We,” “Us,” “Our,” “KML” means Koliqi Marble Limited (parent company).  
  • “The Customer,” “You” means you, whether you are a private individual, corporate entity, or any other entity.  

Application

These Terms apply to all quotations made by KML Worktops and to any contract, oral or written, for the supply of work and materials entered into by KML Worktops, unless otherwise agreed in writing between the parties prior to such contract.  

Your Rights

These Terms are designed to ensure you receive a fair deal and understand your rights. If you have any questions, please contact us for clarification. These Terms do not affect your statutory rights.  

Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the English courts.  

Severability

If any part of these Terms is unenforceable, it shall be deemed deleted, and the remaining provisions shall still apply.  

Changes to Terms

These Terms are subject to change without notification but remain valid for any contract once a deposit has been paid.  

Precedence

If these Terms conflict with any terms in the purchaser’s order, these Terms prevail.  

Price and Payment

  • A 50% deposit is required upon placing an order, unless otherwise agreed in writing.  
  • This deposit is refundable if your order is not accepted.  
  • Placing an order signifies acceptance of these Terms.  
  • Deposits are refundable upon cancellation, but we may deduct costs incurred.  
  • The balance is due before completion or delivery.  
  • We may charge interest on overdue payments.  
  • Late payment invalidates any guarantee.  
  • Prices are based on ground and first-floor installations; a site survey is required.  
  • Surcharges may apply for higher floors.  
  • You must inform us of any access restrictions.  
  • Work outside the M25 may incur a surcharge.  
  • You must pay the full price without deductions.  
  • You must pay for any additional work agreed upon.  
  • We retain ownership of goods until paid in full.  
  • You must hold resale proceeds as trustee until we are paid in full.  
  • We may recover goods if payment is overdue.  
  • VAT applies to UK residents.  

Cancellation

  • We may cancel the contract if unable to provide adequate service.  
  • Your deposit will be refunded, less any costs incurred.  
  • Our decision is final.  
  • We are not liable for any costs except for death or personal injury.  
  • Quotations are not a guarantee of acceptance.  
  • Orders are subject to availability.  
  • You will be informed of order acceptance and attendance date.  
  • You may cancel your order within 7 working days of acceptance.  
  • Cancellation is subject to certain conditions.  
  • Neither party is liable for failure to perform due to Acts of God.  

Performance

  • We ensure safe building practice.  
  • You are responsible for any additional work required for compliance.  
  • We aim for timely completion but are not liable for delays beyond our control.  
  • Minor plaster damage may occur during installation.  
  • You must provide access and utilities.  
  • We will arrange templating and recommend your presence.  
  • We will make decisions in your absence, but are not liable for any resulting issues.  
  • Changes after templating are your responsibility.  
  • You are responsible for ensuring level and secure units.  
  • You must provide parking and access.  
  • You are responsible for plumbing, electrical work, and making good.  
  • We recommend you approve slabs at our factory.  
  • Natural materials are subject to variations.  
  • Fabrication is usually within 10 working days, subject to delays.  
  • We provide a guarantee in accordance with Stone Federation guidelines.  
  • We provide maintenance instructions but are not liable for improper maintenance.  

Disputes

  • Complaints must be made in writing within 5 working days of completion.  
  • You will indemnify us for costs incurred due to your breach of these Terms.  

Special Conditions

  • Marble and granite have natural veins.  
  • Gluing loose pieces is customary for some materials.  
  • Treatment of stone with resins is sometimes necessary.  
  • Material descriptions are for guidance only.  
  • We adhere to Stone Federation GB guidelines.  
  • Large cutouts weaken the stone, and you proceed at your own risk.  
  • We aim to minimize joints but may add them if necessary.  
  • All work is sealed, but this is not a guarantee against stains.  
  • Material thickness can vary slightly.  
  • Granite may be susceptible to “blowing out.”  
  • Granite can have natural flaws and variations in color.  
  • Breakages can occur, causing delays.  
  • “Jinny” marks may be unavoidable.  
  • Exact resemblance to samples cannot be guaranteed.
